Red Light North

These Terms of Service ("Terms") are a binding legal agreement between you and Red Light North ("Red Light North," "we," "us," or "our"). These Terms govern your access to and use of our website, applications, messaging tools, features, and related services (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT USE THE SERVICE.

1. Acceptance of Terms

By using the Service, you confirm that:

  • You are the age of majority in your jurisdiction and where you access the Service.
  • You are legally capable of entering into binding agreements.
  • You agree to comply with all applicable laws.
  • You understand that the Service contains user-generated content.

These Terms incorporate by reference all policies posted by Red Light North, including but not limited to Privacy Policy, Posting Guidelines, Reporting Policies, and Copyright Policies.

2. Description of Service

Red Light North provides an online platform allowing users to post content, communicate, and connect with others. The Service may include listings, messaging, social features, advertisements, notifications, and other online tools.

Any new features or services added to the platform are automatically subject to these Terms.

3. Neutral Platform; No Endorsement or Agency

Red Light North is a neutral online platform.

You understand and agree that:

  • We do not create, verify, monitor, endorse, sponsor, or guarantee user content or user behavior.
  • We are not an agent, broker, representative, employer, or participant in any interactions between users.
  • We are not a party to any agreements, communications, meetings, or transactions between users.
  • Any interactions with other users occur entirely at your own risk.

4. Eligibility and Age Restrictions

The Service is strictly for adults.

You must be the age of majority in your jurisdiction to use the Service. Minors are prohibited from accessing or appearing in any content.

Any suspected unlawful or exploitative material may be reported to law enforcement authorities.

5. Accounts and Security

If you create an account:

  • You must provide accurate and current information.
  • You are responsible for all activities under your account.
  • You must keep your login credentials secure.
  • You must notify us immediately of unauthorized access.

Accounts are non-transferable. We may suspend or terminate accounts at our sole discretion.

6. User Content and Responsibility

Users may post text, images, videos, links, listings, profiles, and messages ("User Content").

You acknowledge and agree:

  • You are solely responsible for all User Content you post.
  • You must have all rights required to publish such content.
  • Your content must comply with applicable laws and these Terms.
  • You submit it — you are responsible for it.

Red Light North does not guarantee the accuracy, legality, or safety of User Content.

7. Prohibited Content and Conduct

You may not use the Service to:

  • Post or facilitate illegal activity.
  • Exploit or depict minors in any way.
  • Promote trafficking, coercion, fraud, or violence.
  • Harass, threaten, defame, or impersonate others.
  • Post infringing or unauthorized intellectual property.
  • Upload malware or destructive code.
  • Scrape, crawl, copy, harvest, or automate data collection.
  • Circumvent security or access controls.
  • Collect personal information without consent.

Violations may result in immediate termination without notice.

8. Content Moderation and Enforcement

We may, but are not obligated to:

  • Review, remove, restrict, or refuse any content.
  • Disable links or listings.
  • Suspend or terminate accounts.
  • Preserve or disclose information when required for legal compliance, safety, or investigations.

We are not liable for removing or failing to remove content.

9. License to Use Content

You retain ownership of your User Content.

By posting content, you grant Red Light North a worldwide, royalty-free, non-exclusive license to host, display, reproduce, distribute, and promote your content as needed to operate and market the Service.

This license continues as long as the content remains on the Service and for reasonable backup, compliance, or archival purposes.

10. No Reliance on User Content

You agree that:

  • User Content may be inaccurate, misleading, offensive, or unlawful.
  • You are solely responsible for evaluating other users or content.
  • Any decisions or interactions based on User Content are entirely at your own risk.

11. Third-Party Links and Advertisers

The Service may include links, ads, or services provided by third parties.

Red Light North does not control or endorse third-party services and is not liable for transactions, losses, or damages resulting from your dealings with them.

12. Communications and Notifications

By using the Service, you agree to receive service-related communications, including account notices, security alerts, and administrative updates.

If you opt into SMS or mobile notifications, standard carrier fees may apply.

13. Payments and Financial Policies

If paid services are offered:

  • Fees may change without notice.
  • All payments are final and non-refundable unless required by law.
  • Payment processing may be handled by third-party providers.

Chargebacks or payment abuse may result in account termination.

14. Service Availability and Data Limits

We do not guarantee uninterrupted access or availability of the Service.

We may establish limits on usage, storage, messaging, or account activity. We are not responsible for deleted, lost, or failed data transmissions.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED.

WE DO NOT GUARANTEE:

  • Continuous operation or error-free performance;
  • Accuracy or reliability of user content;
  • Safety or legality of user interactions;
  • That the Service will meet your expectations.

Your use of the Service is entirely at your own risk.

16. Limitation of Liability

To the maximum extent permitted by law, Red Light North and its owners, affiliates, employees, agents, and service providers shall not be liable for:

  • User conduct or content;
  • Personal interactions or arrangements between users;
  • Loss of profits, data, business, or goodwill;
  • Indirect, incidental, consequential, or punitive damages.

Our total liability for any claim shall not exceed CAD $100.

17. Indemnification

You agree to defend, indemnify, and hold harmless Red Light North and its affiliates from any claims, liabilities, damages, costs, or expenses arising from:

  • Your use of the Service;
  • Your User Content;
  • Your violation of these Terms or applicable laws.

18. Privacy and Data Handling

Use of the Service is subject to our Privacy Policy.

We may retain account and content information where required by law, to protect users, or to resolve disputes.

19. Modification or Termination of Service

We may modify, suspend, or discontinue the Service at any time without liability.

We may terminate accounts or remove content for any reason, including legal compliance, safety concerns, or policy violations.

20. Governing Law and Disputes

These Terms are governed by the laws of Ontario, Canada and the federal laws of Canada applicable therein.

Any disputes shall first be attempted to be resolved through good-faith negotiation. Where permitted by law, unresolved disputes may be resolved through confidential arbitration in Ontario, Canada.

You agree to pursue claims individually and waive class-action participation where legally permitted.

21. Copyright Policy

If you believe content infringes your copyright, you may contact us with:

  • Your contact information;
  • Identification of the copyrighted material;
  • URL or location of the allegedly infringing content;
  • Description of the infringement.

Repeat infringers may have accounts terminated.

22. General Provisions

  • These Terms constitute the entire agreement between you and Red Light North.
  • If any provision is deemed unenforceable, remaining provisions remain in effect.
  • Failure to enforce any provision does not waive our rights.
  • Section headings are for convenience only.
